1. The employer failed to implement and maintain an effective COVID-19 Prevention Program. The employer has procedures in the plan regarding an electronic badge system for COVID-19 testing requirements that is not being followed or enforced. Title 8 CCR § 3205(c) 2. The employer failed to exclude employees with COVID-19 exposure from the workplace for 10 days after the last known COVID-19 exposure to a COVID-19 case. Employee was within 6 feet of a COVID-19 positive case for over 40 minutes and told they did not need to be excluded from work. Title 8 CCR § 3205(c)(10)(B) 3. The employer failed to provide voluntary N95 respirator users with the information contained in Appendix D to § 5144 (Information for Employees Using Respirators When Not Required Under the Standard). N95 respirators were made available to custodial staff without any training information. Title 8 CCR § 5144(c)(2)(A) 4. The employer failed to maintain physical distancing by at least six feet. Employees share a break schedule and breakroom that does not allow the space for physical distancing. This occurs at Clark Kerr, Unit 1, Unit 2 and Unit 3. Title 8 CCR § 3205(c)(6)(A)
