1. The employer did not implement and maintain an effective Aerosol Transmissible Diseases Exposure Control Plan which is specific to cafeteria employees who must deliver meals to patients throughout the hospital. T8 CCR 5199(d)(1). 2. The employer did not ensure that work practices and engineering controls were implemented to minimize employee exposure to ATDS and where such practices and controls are insufficient, ensure that employees are properly protected with Personal Protective Equipment (PPE) and proper respiratory protection equipment for staff working in the cafeteria and delivering food trays to patients in the hospital.
